On World Population Day 2021, Uttar Pradesh Chief Minister Yogi Adityanath inaugurated the state’s population policy 2021-30. The state’s total fertility rate is 2.7 percent currently. UP has a population of 23.40 crore.

The Law Commission has uploaded its draft on the official website and by July 19, public opinion has been sought. This draft has been introduced at a time when the Yogi government is going to issue a new population policy on July 11.

The new population policy is prepared for 2021-2030. This law encourages to promote the two-child policy in the state. It has been said in this draft that the ration card of a person with more than two children will be limited to four members and he will not be eligible to receive any kind of government subsidy.

Let us tell you that, according to this draft, a person with more than two children will not get the benefit of government schemes. That person will not be able to apply for a government job nor contest the election of any local body. The commission has sought public opinion by July 19.

UP Population Control Bill 2021 Draft PDF in Hindi English: यूपी जनसंख्या कानून – The Uttar Pradesh government released the new population policy for 2021-2030 on the occasion of World Population Day. In the new population policy, a target has been set to bring the birth rate to 2.1 per thousand population by 2026 and to 1.9 by 2030.

Two more children then these deductions–

2- Not more than four members in the ration card

3- Local bodies, panchayats will not be able to contest elections

The provision of this Act shall apply to a married couple where the boy is not less than 21 years of age and the girl is not less than 18. Suggestions have been invited from the public to improve the draft bill and July 19 is the last date for it.

• On the occasion of World Population Day, Chief Minister Yogi Adityanath has announced Population Policy 2021-30.
• For population control in UP, the State Law Commission has prepared the draft Population Control Bill-2021.

UP Govt 2 Child Policy Population Control Bill Draft PDF, Rules, Benefits, Suggestions: The Yogi Adityanath government of Uttar Pradesh has prepared the draft of the UP Population Bill 2021 for the country’s most populous state. By uploading it on the website, opinion has been sought from the public till July 19.

The State Law Commission of Uttar Pradesh after considering the public opinion will hand over the same to the State Government. This draft suggests avenues of legal measures for population control in Uttar Pradesh. All the facilities are being given to the parents with two or less children, while there is a provision to deprive the parents of more children from many facilities.

Incentives for Public Servants (two children):

Public servants who adopt the two-child norm will get two additional increments during the entire service, maternity or as the case may be, paternity leave of 12 months, with full salary and allowances and three percent increase in the employer’s contribution fund under the National Pension Scheme.

The public servants under the control of State Government who adopts two-child norm by undergoing voluntary sterilization operation upon himself or spouse, shall be given the following incentives—

• two additional increments during the entire service;
• subsidy towards the purchase of plot or house site or built house from Housing Board or Development Authority, as may be prescribed;
• soft loan for construction or purchasing a house on nominal rates of interest, as may be prescribed;
• rebate on charges for utilities such as water, electricity, water, house tax, as may be prescribed;
• Maternity or as the case may be, paternity leave of 12 months, with full salary and allowances;
• three percent increase in the employer‘s contribution Fund under national pension free health care facility and insurance coverage to a spouse; and
• such other benefits and incentives, as may be prescribed.

Incentives for Public Servants (One Child):

The public servant, who have only one-child and undergo voluntary sterilization operation upon himself or spouse, in addition to the incentives provided under Section 4, shall be given the following incentives,—

• two additional increments during the entire services Provided that the additional increments provided shall be in addition to the increments provided under clause (a) of Section 4;
• free health care facility and insurance coverage to the single child till he attain the age of twenty years;
• preference to a single child in admission in all education institutions, including but not limited to Indian Institute of Management, All India Institute of Medical Science etc.;
• free education up-to graduation level;
• scholarship for higher studies in case of a girl child;
• preference to a single child in government jobs; and
• such other benefits and incentives, as may be prescribed.

Incentives to the general public (two children):

All those common citizens who are not public servants and after the birth of two children get sterilization of themselves or their husband or wife of their own free will, they will be provided the following benefits.

• Soft loan for construction of house at very low interest rate
• Exemption on utility like water, electricity, house tax etc.
• 12 months leave on the birth of child with full pay and allowances

Incentives to the general public (one child):

All those common citizens who are not public servants and after the birth of a child voluntarily undergo sterilization of themselves or their spouses, they will be provided the following benefits.

• Soft loan for construction of house at very low interest rate
• Exemption on utility like water, electricity, house tax etc.
• 12 months leave on the birth of child with full pay and allowances
• Free health care facility and insurance coverage for the child till the age of 20 years
• Priority in granting admission to the child in other educational institutions including Indian Institute of Management, All India Institute of Medical Science etc.
• Free education up to graduation level
• Scholarship to Girls for Higher Studies
• priority in government job etc.

Special Benefit to Couple Living under the Below Poverty Line. —

A couple living below the poverty line, having only one-child and undergo voluntary sterilization operation upon himself or spouse shall be eligible for payment from the Government for a one-time lump-sum amount of rupees eighty thousand if the single child is a boy, and rupees one lakh ifthe single child is a girl.

UP Govt Population Control Draft Bill: Disincentives, Revocation of Incentives

After the commencement of this Act, in contravention of two child norm procreates more than two children shall be ineligible to avail any incentives and benefits provided under Section (4) to Section (7), and, in addition thereto, shall be subject to additional disincentives like:-

• Only four members can be included in the ration card.
• The benefit of government grant will also not be provided
• Debarred from contesting local body elections.
• will not be able to apply for government jobs
• Government employees will not be given promotion

U P Jansankhya Kanoon Exception

The following exceptions will be included if the UP Population Act is implemented.

• Multiple births from second pregnancy
• If a person has two children on his own and the third child is adopted
• Disability status of the first or second child
• death of the first, second or both children
• A couple who at the time of the commencement of this Act is pregnant with a third child
• polygamy status

Special provision in case of polygamy

• Couples who have more than one marriage under personal law will be under the purview of the law.
• Polygamists do not benefit from facilities if they have more than two children from all wives.
• If every wife has two children, then continue Convenience.
• Denied benefit, if a woman marries more than one, having more than two children from different husbands.

Free education on adopting one child policy

• It is proposed to specially encourage the parents of BPL category who accept One Child Policy.
• Under this, the parents who will get the operation done after the birth of the first child, many facilities will be given to them.
• A special incentive of Rs 77 thousand will be given for the first child and one lakh on the girl child.
• The daughter of such parents will get free education till higher education while the son will get free education till 20 years.

• If any couple have two babies from first pregnancy on 1.1.2021 and gave birth to two more babies out of from second pregnancy on 1.1.2023 then the couple is under contravention. This clearly means you will violate this policy of UP government.
• If any couple has no baby from their marriage and they adopted two children then the couple in not under any contravention.
• If couple had no children from their marriage but adopted more than two children then they are under contravention.
• If couple had two children out of from their marriage and adopted one child then they are not in under any contravention.
• If couple had two children and adopted two or more children then also they are under contravention of 2 child policy in UP.
